8 Year Old Brain Damaged Girl has Settlement Approved

The family of young Elke Wisbey, who was brain damaged at birth due to a lack of oxygen, has had their negotiated settlement approved in the High Court.

Elke, from Bearsted, Kent, was born by emergency Caesarean section at Maidstone Hospital in 2002, but was starved of oxygen during her delivery – resulting in quadriplegic cerebral palsy. Now 8 years of age, Elke requires full-time care and will do so for the rest of her life.

In a pre-court action brought by Elke’s mother Glynnis, it was claimed that doctors were aware of complications due to Elke’s breach position and had they acted even 15 minutes earlier, Elke would have made a full recovery.

The settlement package agreed between the Wisbeys and Maidstone and Tunbridge Wells NHS Trust provides an immediate lump sum payment of 900,000 pounds for Elke, and annual payments of 100,000 pounds until Elke reaches the age of 19, when they will be increased to 155,000 pounds.

The agreement was reached without admission of liability.
